General Terms and Conditions of Namur Nature

These general terms and conditions apply to all contracts entered into between Namur Nature, specializing in the sale of vacation rentals, and its customers. By entering into a contract with Namur Nature, the customer declares his acceptance of these general terms and conditions.

1. Definitions.

In these terms and conditions, the following terms have the following meanings:

  • Namur Nature: The company offering and selling vacation homes in the vacation park in Gesves.
  • Customer: The natural or legal person who enters into a contract with Namur Nature for the purchase of a vacation rental or the use of services.
  • Agreement: Any agreement between Namur Nature and the customer regarding the purchase of a vacation rental or related services.
  • Vacation: The properties offered by Namur Nature within the park for sale to customers.

2. Applicability.

These general conditions apply to all offers, agreements, services and transactions between Namur Nature and the customer, unless otherwise agreed in writing. Deviations from these terms and conditions are valid only if they are in writing and signed by both parties.

3. Offers and Offers.

  • All quotations and offers from Namur Nature are without obligation, unless a deadline for acceptance is specified in the quotation. If no deadline is indicated, the offer remains valid for 30 days.
  • Prices in quotations include VAT unless otherwise stated.
  • Namur Nature reserves the right to modify or withdraw quotations before a contract is finalized.

4. Conclusion of the Agreement.

A contract between the customer and Namur Nature is concluded when the customer accepts the offer provided by Namur Nature in writing or digitally and Namur Nature confirms this acceptance.

5. Payment.

  • Payments shall be made in accordance with the arrangements set forth in the contract.
  • If the customer fails to pay on time, the customer will be in default without further notice and Namur Nature is entitled to charge statutory interest from the due date of the invoice.
  • If payment is not made, Namur Nature reserves the right to cancel the contract and sell the property to another party. Any costs incurred in doing so will be borne by the client.

6. Cancellation and dissolution.

  • The customer is entitled to cancel the contract free of charge within 14 days of the conclusion of the contract, unless work has already been performed by Namur Nature.
  • Namur Nature reserves the right to cancel the contract with immediate effect if the customer fails to fulfill his obligations or in the event of the customer's bankruptcy.

7. Delivery of the vacation home.

  • The vacation rental will be delivered on the agreed date specified in the contract, unless there is force majeure or a delay beyond the control of Namur Nature.
  • If delivery is delayed due to force majeure, the client will be notified as soon as possible and a new delivery date will be agreed. Force majeure includes, but is not limited to, natural disasters, pandemics, and government actions.
  • The client must inspect the property upon completion. Any defects must be reported in writing within 7 days of completion.

8. Liability.

  • Namur Nature shall not be liable for any damage arising from the agreement, unless there is intent or gross negligence.
  • Namur Nature shall never be liable for indirect damages, including consequential damages, lost profits, missed savings or damages due to business interruption.
  • Namur Nature's liability is limited to the amount paid by the customer for the vacation rental.

9. Use of the vacation rental.

  • The customer is obliged to use the vacation home according to the destination and the applicable rules of the vacation park. The customer may not use the accommodation for commercial activities without Namur Nature's prior consent.
  • Selling or subletting the vacation rental is only permitted with the prior written consent of Namur Nature.
  • The client is responsible for the maintenance of the vacation home and must keep the home in good condition.

10. Formal force.

Namur Nature is not obliged to fulfill any obligation if prevented from doing so by force majeure. Force majeure means any circumstance beyond the control of Namur Nature, as a result of which performance of the agreement cannot reasonably be required, such as fire, war, natural disasters, pandemics or other external circumstances.

11. Disclosure.

Namur Nature and the customer are obliged to keep confidential any confidential information received from the other party under the agreement, unless legal obligations require otherwise.

12. Complaint procedure.

  • Complaints about the performance of the agreement must be submitted to Namur Nature in writing, stating reasons, within 14 days of discovery.
  • Namur Nature will respond in writing within 30 days of receipt of the complaint and strive to find an appropriate solution.

13. Applicable Law and Disputes.

  • All agreements and disputes between Namur Nature and the customer shall be governed by Belgian law.
  • Disputes shall be submitted exclusively to the competent court in the district in which Namur Nature is located, unless the parties agree on a different solution.

14. Modifications to the General Terms and Conditions.

Namur Nature reserves the right to amend these general terms and conditions at any time. The amended terms and conditions shall come into force as soon as they are published on Namur Nature's website or communicated to the customer.

15. Final provisions.

  • If any provision of these general terms and conditions is found to be invalid, the remaining provisions shall remain in full force and effect.
  • The customer may not assign rights and obligations under the agreement to third parties without Namur Nature's prior written consent.
